CouponCabin.com Settles Trademark Infringement LawsuitCoupon Chief, Inc. Agrees to Stop Using Infringing Coupons And Pays Undisclosed Sum for Past UsePRNewswireCHICAGOOct. 20

CHICAGO, Oct. 20 /PRNewswire/ -- CouponCabin.com, a Chicago-based consumer coupon website, recently settled a lawsuit that it had filed against Coupon Chief, Inc. relating to Coupon Chief's use of CouponCabin.com coupon codes, all of which featured variations of CouponCabin.com's trademarks.

CouponCabin.com filed the lawsuit on January 27, 2009 with the United States District Court for the Northern District of Illinois. In its complaint, CouponCabin.com asserted claims for trademark infringement, unfair competition, tortious interference with contractual relations and unjust enrichment against Coupon Chief.

On October 8, 2009, the parties entered a Settlement Agreement resolving all claims asserted by CouponCabin.com. Pursuant to the Settlement Agreement, Coupon Chief agreed to stop using coupon codes featuring CouponCabin.com's trademarks and confusingly similar variations of those marks. Coupon Chief also committed to implement software to preclude third parties from publishing those coupon codes on Coupon Chief's website in the future. Finally, Coupon Chief paid CouponCabin an undisclosed sum for its past conduct.

"We are relieved that after months of litigation, we have finally come to an agreement with Coupon Chief that addresses all of our concerns with respect to its past conduct," said Scott Kluth, Founder and President of CouponCabin.com. "Through this settlement, we were able to hold Coupon Chief accountable for its use of our content and obtain the necessary commitments to hopefully negate the need for future legal actions against it."

Matthew Walch, a partner with Latham & Watkins, LLP represented CouponCabin.com in the Illinois action. Mr. Walch noted, "CouponCabin.com's pursuit of this case established that it will not stand idly by if its competitors misappropriate its hard work and efforts for their own commercial benefit."

Kluth added, "We are extremely grateful for all of our success in the online coupon industry. While we fully support healthy competition in that industry, such competition always needs to be carried out within the bounds of the law."
